July 2010 Negotiations

VOTE RESULTS

The voting results for the first APECS Contract Extension were as follows: 60 in favor, 29 opposed, and 19 additional votes excluded for non-membership (in both catagories, maintaining the same ratio).

While these votes were being counted, the County Labor Relations Office contacted APECS with information about other union offers being reached. These offers are being taken to the Board of Supervisors on July 13th, in closed session, for approval. These offers include one-year extensions (with the 2% deferred COLA), two-year extensions (with the 2% deferred COLA), and at least one three-year extension (LEMA) with an additional COLA during the extension period as well as the deferred 2% COLA. Labor Relations asked if APECS would be interested in exploring any modifications to our concession agreement prior to July 13th. A critical component of the other offers, and the reason the County wanted us back at the table, was language to accept a newly defined retirement tier for new hires. As these contract extensions have started to push out two and three years, the County is encountering their future agenda for benefit reductions. We agreed to return to the table to discuss possible options.

We met last week and negotiated a Tentative Agreement (TA) for a three-year extension to our current contract. TA means that both parties agree to seek approval of the agreement from their respective authority. APECS members must vote on this TA, AND the Board of Supervisors must approve the offer before it can be put into effect. As the first offer was approved to defer the COLA, we agreed to suspend the implementation of the immediate 2% COLA until the TA could be voted upon. The Replacement Offer is attached here, and summarized as follows:

REVISED CONTRACT EXTENSION PROPOSAL

  • Defer the immediate 2% COLA, with restoration in June 2012, same as previously proposed.
  • No additional COLA's during the term of the contract. NOTE: This would constitute a loss of three COLA's, June 2011, June 2012, and June 2013. This would put us in the typical situation to negotiate the start-up COLA at the beginning of our new contract to begin July 2014.
  • (2) Paid Administrative Days for each of the four years, for a total of (8) Paid Administrative Days.
  • Extension of the re-employment lists from two years, out to three years. NOTE: This extends the time the County must re-employ those that have been laid off, if re-hiring occurs during that timeframe.
  • Language to accept a new retirement tier, should the County successfully negotiate terms with all the other bargaining units covering miscellaneous members. This is preliminarily described as 2% at 60.

ADDITIONAL VOTE

An electronic vote will be conducted between Friday, July 9th, 1:00 pm and Monday, July 12th, 5:00 pm. We will close the vote and tally on Monday, July 12th at 5:00 pm. Results will be announced on Tuesday, July 13th, via email.

PLEASE NOTE: If this Proposal fails to gain APECS approval through a majority vote, the APECS Board will accept the original offer of a 1-year extension.
